By downloading, installing, accessing, or using MotorScribe (the "App"), you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree in their entirety, you must immediately cease using the App.

These Terms constitute a legally binding agreement between you and MotorScribe, operated by an individual developer based in Maryland, USA. Your continued use of the App following any modification constitutes acceptance of the modified Terms.

MotorScribe is a personal vehicle record-keeping application for iOS. It allows users to log service entries, maintenance records, modifications, receipts, and documents for their vehicles. Features include:

• AI-powered receipt and document scanning via Google Gemini AI
• Vehicle photo and document storage via Apple CloudKit
• Weather alerts for vehicle care via Apple WeatherKit
• Local maintenance reminders via on-device push notifications
• An optional public Community Builds feed
• PDF export of vehicle service history

MotorScribe is not a mechanic, repair shop, automotive advisor, or vehicle history certification service. We do not diagnose vehicle problems, recommend specific repairs, or verify any data entered by users.

MotorScribe uses Sign in with Apple as its sole authentication method. By creating an account, you agree to provide accurate information and maintain the security of your Apple ID. You are responsible for all activity that occurs under your account. MotorScribe does not store passwords.

You are solely and exclusively responsible for the accuracy, completeness, and truthfulness of all records you enter into MotorScribe. MotorScribe does not cross-reference your records against any third-party database including CARFAX, AutoCheck, NMVTIS, DMV records, or any OEM service database.

You agree to indemnify and hold MotorScribe harmless from any claim, loss, damage, or liability arising from the inaccuracy of your records or their misuse.

MotorScribe uses Google Gemini AI to parse receipts, identify vehicles, and generate maintenance insights. You acknowledge that:

• AI-generated content may contain errors, misreadings, or misinterpretations
• AI insights are informational only, based on publicly available community knowledge
• You must review and verify all AI-extracted data before saving it as a record
• AI output does not constitute professional mechanical advice and should not be relied upon for any consequential decision including vehicle purchase, sale, or repair

Weather notifications in MotorScribe are provided for informational convenience using Apple WeatherKit data processed entirely on your device. MotorScribe does not guarantee the accuracy of weather data and is not liable for any damage to vehicles, property, or any other loss arising from reliance on weather notifications. Always consult authoritative weather sources before making decisions about vehicle care or storage.

The Community Builds feature is optional and opt-in. By posting to the community feed, you:

• Confirm the vehicle is legally in your possession or you have explicit authorization from the owner to post
• Acknowledge all community content is labeled "Self-reported by owner" and is not verified by MotorScribe
• Grant MotorScribe a non-exclusive, royalty-free, worldwide license to display your content within the App
• Agree that community content must not depict stolen vehicles, unlicensed illegal modifications, or emissions fraud

MotorScribe reserves the right to remove any community content at its sole discretion without notice.

You expressly agree that you will NOT use MotorScribe, or any output generated by MotorScribe, for any of the following:

MotorScribe reserves the right to remove content and terminate accounts for violations. We will cooperate fully with law enforcement investigations.

The MotorScribe name, logo, app design, and all associated content are the intellectual property of MotorScribe. The app is protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, or reverse-engineer any part of the App without express written permission.

You retain ownership of all vehicle records and content you create within the App. By posting to the Community Builds feed, you grant the limited license described in Section 7.

MotorScribe offers three tiers:

• Free — 1 vehicle, limited records and scans, free forever
• Enthusiast — $5.99/month or $59.99/year
• Collector — $14.99/month or $143.99/year

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. To cancel, go to Settings → Apple ID → Subscriptions → MotorScribe. We reserve the right to update pricing with reasonable notice. Continued use after a price change constitutes acceptance.

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOTORSCRIBE EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING:

• Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement
• Any warranty that the App will be uninterrupted, error-free, or free of inaccuracies
• Any warranty regarding the accuracy or reliability of AI-generated content
• Any warranty that weather alerts are accurate or sufficient for vehicle care decisions
• Any warranty that records reflect the actual condition or history of any vehicle

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOTORSCRIBE, ITS DEVELOPER, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

• Your use of or inability to use the App
• Reliance by any party on records, AI output, or weather alerts generated through the App
• Any vehicle damage arising from reliance on weather notifications
• Any financial loss including vehicle sale disputes, insurance claim denials, or loan decisions
• Any legal liability incurred as a result of fraudulent use of the App

IN NO EVENT SHALL MOTORSCRIBE'S AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO MOTORSCRIBE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

MotorScribe reserves the right to suspend or permanently terminate your access to the App, with or without notice, for violation of these Terms, suspected fraud or illegal activity, or any conduct determined to be harmful to users or the integrity of the platform. Sections 4, 8, 11, 12, and 14 survive termination.

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, USA, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction for any actual or threatened violation of intellectual property rights.

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

MotorScribe reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date and, where required, through in-app notification. Your continued use of the App after the effective date constitutes acceptance of the modified Terms.
